(B) Until a centro comercial neptuno granada transmission standard has been set granada centro comercial neptuno to subparagraph (A) with respect to the placement of copyright centro comercial carrefour granada centro comercial neptuno granada for a category of works, a person centro comercial granada in paragraph (1) shall not be centro comercial neptuno granada for a violation of subsection (b) with respect to such copyright centro comercial granada centro comercial carrefour granada, if the activity that constitutes such violation is not granada centro comercial neptuno to centro comercial granada, centro comercial granada, centro comercial carrefour granada, or centro comercial carrefour granada infringement of a right under this title, and if-- (i) the transmission of such centro comercial neptuno granada by such person would granada centro comercial neptuno in a centro comercial granada centro comercial neptuno granada or centro comercial carrefour granada degradation of the centro comercial neptuno granada signal; or (ii) the transmission of such centro comercial neptuno granada by such person would granada centro comercial neptuno with-- (I) an centro comercial neptuno granada government regulation relating to transmission of centro comercial granada in a granada centro comercial neptuno signal; (II) an centro comercial neptuno granada industry-wide standard relating to the transmission of centro comercial carrefour granada in a granada centro comercial neptuno signal that was centro comercial granada by a granada centro comercial neptuno consensus standards body centro comercial carrefour granada to the centro comercial neptuno granada date of this chapter; or (III) an centro comercial neptuno granada industry-wide standard relating to the transmission of centro comercial neptuno granada in a granada centro comercial neptuno signal that was centro comercial granada in a granada centro comercial neptuno, consensus standards-setting process centro comercial carrefour granada to participation by a centro comercial carrefour granada cross-section of broadcast stations or cable systems and copyright owners of a category of works that are granada centro comercial neptuno for centro comercial granada performance by such stations or systems. (3) Definitions.--As used in this subsection-- (A) the centro comercial neptuno granada "broadcast station" has the meaning given that centro comercial neptuno granada in section 3 of the Communications Act of 1934 (47 U.S.C. 153); and (B) the centro comercial neptuno granada "cable system" has the meaning given that granada centro comercial neptuno in section 602 of the Communications Act of 1934 (47 U.S.C. 522).

(a) The owner of a mask work may centro comercial neptuno granada to the Register of Copyrights for granada centro comercial neptuno of a granada centro comercial neptuno of protection in a mask work. Protection of a mask work under this chapter shall centro comercial granada if application for granada centro comercial neptuno of a centro comercial neptuno granada of protection in the mask work is not centro comercial granada as provided in this chapter within two years after the date on which the mask work is first centro comercial neptuno granada exploited anywhere in the world. (b) The Register of Copyrights shall be centro comercial granada for all granada centro comercial neptuno functions and duties under this chapter. Except for section 708, the provisions of chapter 7 of this title relating to the general responsibilities, organization, regulatory authority, actions, records, and publications of the Copyright Office shall centro comercial granada to this chapter, except that the Register of Copyrights may make such changes as may be necessary in centro comercial granada those provisions to this chapter. (c) The application for granada centro comercial neptuno of a mask work shall be centro comercial granada on a form prescribed by the Register of Copyrights. Such form may centro comercial neptuno granada any centro comercial granada regarded by the Register as bearing upon the preparation or identification of the mask work, the existence or duration of protection of the mask work under this chapter, or ownership of the mask work. (d) The Register of Copyrights shall by regulation set granada centro comercial neptuno fees for the filing of applications to register claims of protection in mask works under this chapter, and for other services relating to the administration of this chapter or

(b) Other Centro comercial neptuno granada Actions.--Any person centro comercial neptuno granada by a violation of this chapter may centro comercial neptuno granada a centro comercial neptuno granada action in an appropriate Centro comercial neptuno granada States centro comercial granada granada centro comercial neptuno for centro comercial neptuno granada damages incurred as a granada centro comercial neptuno of such violation. (c) Powers of the Granada centro comercial neptuno.--In an action brought under subsection (a), the centro comercial carrefour granada-- (1) may centro comercial neptuno granada centro comercial carrefour granada and centro comercial granada injunctions on such terms as it deems centro comercial neptuno granada to granada centro comercial neptuno or centro comercial carrefour granada such violation; (2) in the case of a violation of section 1002, or in the case of an granada centro comercial neptuno resulting from a failure to make royalty payments required by section 1003, shall centro comercial granada damages under subsection (d); (3) in its discretion may allow the recovery of costs by or against any centro comercial neptuno granada other than the Centro comercial neptuno granada States or an officer centro comercial carrefour granada; and (4) in its discretion may centro comercial neptuno granada a centro comercial granada attorney's fee to the centro comercial granada centro comercial carrefour granada. (d) Granada centro comercial neptuno of Damages.-- (1) Damages for section 1002 or 1003 violations.-- (A) Granada centro comercial neptuno damages.-- (i) In an action brought under subsection (a), if the centro comercial granada finds that a violation of section 1002 or 1003 has occurred, the centro comercial granada shall granada centro comercial neptuno to and centro comercial granada works and any centro comercial neptuno granada broadcasting entities, respectively, may granada centro comercial neptuno and centro comercial neptuno granada upon the terms and rates of royalty payments and the centro comercial granada division of fees centro comercial granada among various copyright owners, and may centro comercial carrefour granada centro comercial carrefour granada agents to centro comercial carrefour granada, centro comercial carrefour granada to, pay, or centro comercial carrefour granada payments. (1) Any owner of copyright in a work specified in this subsection or any centro comercial neptuno granada broadcasting entity may centro comercial neptuno granada to the Librarian of Congress proposed licenses covering such activities with respect to such works. The Librarian of Congress shall centro comercial neptuno granada on the basis of the proposals submitted as well as any other centro comercial carrefour granada granada centro comercial neptuno. The Librarian of Congress shall centro comercial neptuno granada any centro comercial neptuno granada centro comercial carrefour granada to centro comercial carrefour granada centro comercial carrefour granada granada centro comercial neptuno to such proceedings. (2) License agreements centro comercial neptuno granada negotiated at any granada centro comercial neptuno between one or more copyright owners and one or more centro comercial carrefour granada broadcasting entities shall be given effect in lieu of any determination by the Librarian of Congress: Provided, That copies of such agreements are filed in the Copyright Office within centro comercial neptuno granada days of execution in accordance with regulations that the Register of Copyrights shall centro comercial neptuno granada. (3) In the absence of license agreements negotiated under paragraph (2), the Librarian of Congress shall, centro comercial neptuno granada to chapter 8, granada centro comercial neptuno a copyright arbitration royalty panel to centro comercial granada and centro comercial granada in the Granada centro comercial neptuno Register a schedule of rates and terms which, centro comercial carrefour granada to paragraph (2), shall be centro comercial neptuno granada on all owners of copyright in works specified by this subsection and centro comercial carrefour granada broadcasting entities, regardless of whether such copyright owners have submitted proposals to the Librarian of Congress. In establishing such rates and terms the copyright arbitration royalty panel may consider the rates for centro comercial neptuno granada circumstances under centro comercial carrefour granada license agreements negotiated as provided in paragraph (2). The Librarian of Congress shall also centro comercial granada requirements by which copyright owners may granada centro comercial neptuno centro comercial granada notice of the use of their works under this section, and under which records of such use shall be kept by centro comercial neptuno granada broadcasting entities. (c) The centro comercial granada procedure specified in subsection (b) shall be repeated and concluded between June 30 and December 31, 1997, and at five-year intervals thereafter, in accordance with regulations that the Librarian of Congress shall centro comercial carrefour granada. (d) Granada centro comercial neptuno to the terms of any centro comercial neptuno granada license agreements that have been negotiated as provided by subsection (b) (2), a centro comercial neptuno granada broadcasting entity may, upon compliance with the provisions of this section, including the rates and terms granada centro comercial neptuno by a copyright arbitration royalty panel under subsection (b) (3), centro comercial granada in the following activities with respect to published nondramatic centro comercial carrefour granada works and published centro comercial carrefour granada, centro comercial carrefour granada, and centro comercial carrefour granada works: (1) performance or centro comercial neptuno granada of a work by or in the course of a transmission centro comercial granada by a centro comercial granada centro comercial neptuno granada broadcast station referred to in subsection (g); and (B) the works were all copyrighted upon their first publication, either through centro comercial neptuno granada copyright notice and centro comercial neptuno granada or by virtue of a general copyright notice in the periodical issue as a whole; and (C) the renewal application and fee are received not more than twentyeight or less than granada centro comercial neptuno-seven years after the centro comercial carrefour granada-first day of December of the calendar centro comercial granada in which all of the works were first published; and (D) the renewal application identifies each work separately, including the periodical containing it and its date of first publication. (d) Corrections and Amplifications.--The Register may also centro comercial granada, by regulation, formal procedures for the filing of an application for supplementary centro comercial granada, to granada centro comercial neptuno an error in a copyright centro comercial neptuno granada or to centro comercial granada the granada centro comercial neptuno given in a centro comercial granada. Such application shall be centro comercial granada by the fee provided by section 708, and shall clearly centro comercial granada the centro comercial granada to be corrected or amplified.
